Is It Retaliation?

Retaliation occurs when:

  • An individual engages in a protected activity.
  • The College or an employee has notice of the individual's protected activity.
  • The College or an employee takes an adverse action contemporaneous with or subsequent to the protected activity.
  • There is a causal connection between the protected activity and the adverse action.
  • The College or an employee does not have a legitimate, nondiscriminatory reason for taking the adverse action.
