Individual Liability For Sexual Harassment

Employees can file administrative complaints of sexual harassment against their supervisors through the Equal Employment Opportunity Commission (EEOC) or the State's Human Rights Commission (HRC). After that, if the complaint hasn't been resolved, they can sue their supervisors in court, and may include other claims like infliction of emotional distress or battery. Supervisors may be held personally responsible for their sexually harassing conduct.

Students are not required to file an administrative complaint before suing for sexual harassment. A student who is a victim of sexual harassment could sue an individual for infliction of emotional distress, battery or other legal claims. And, again, the individual defendant may be held personally liable.
