Renton Technical College's Obligation To Provide A Defense/Indemnification
- Renton Technical College is generally required to provide its employees a defense in litigation where it is alleged that the employee in question either did something, or failed to do something, that was within the course and scope of his/her employment and where the conduct in question was not the result of actual fraud, corruption or malice.
- If Renton Technical College provides a defense, it must also pay any judgment entered against the employee for compensatory damages, provided that the employee has cooperated in good faith.
Sexual harassment is generally not considered part of the job or, more precisely, it's not "within the course and scope of employment." As such, it will almost always be the case that Renton Technical College will not defend and/or indemnify any College employee who unlawfully sexually harasses a student or fellow employee.
